General Information
These Terms and Conditions ("Agreement") govern the provision of balloon decoration services by [Cotswold Balloons] ("the Company") to the Client. By booking our services, the Client agrees to be bound by the following terms and conditions.
These Terms and Conditions govern the booking and provision of services by Cotswold Balloons for balloon displays and associated prop hire (including but not limited to sailboards, plinths, easels, etc.) for events such as birthdays, weddings, and corporate functions.
By submitting payment for the booking fee (deposit) or any portion of the invoice, the Client confirms that they have reviewed and accepted these Terms and Conditions.
A physical signature is not required; payment acts as acknowledgment and agreement to all outlined terms’’
A booking is considered confirmed once the Client has paid a non-refundable booking fee . The remaining balance is due 2 weeks prior to the event date unless otherwise agreed in writing.
To secure your booking, a non-refundable deposit of £50 is required immediately upon confirmation of your event date. This deposit will be deducted from the total balance.
Payments can be made via the details provided on your invoice. All payments must be completed in full before the event setup, unless otherwise agreed in writing. Payments should be made in full no less than 14 working days before the event. The service will not be provided unless paid in full on or before the agreed date. If the booking is accepted less than 14 days before the event date, the payment must be made in full.
The remaining balance is due as follows:
2.3 Pricing
Prices for prop hire are agreed upon prior to booking. The total hire fee will include the cost of the props, delivery, setup, and collection, unless otherwise specified. Any additional costs, such as damages or late return fees, will be charged separately.
If you need to cancel your booking, please notify us as soon as possible. The deposit is non-refundable.
Cancellations made less than 14 days before the event will incur a cancellation fee of 20% of the total booking cost.
In the unlikely event that we must cancel your booking due to circumstances beyond our control, we will offer you a full refund of any payments made, including the deposit, less any costs incurred for items that have already been purchased for the event.
3.3 Rescheduling
If the Client wishes to reschedule the event, the Company will make every effort to accommodate the new date, subject to availability. Additional fees may apply if the new date requires a change in the scale or complexity of the decoration. The client will be liable for any fees incurred as a result of rescheduling including but not limited to, the purchase of stock, van or equipment hire. Invoices for such fees will be provided to the client.
The client is responsible for the care and safety of any hired props during the event. Any loss or damage incurred will be charged to the client at replacement cost.
The Client agrees not to leave props outside overnight or unattended in public places or in any such place that props can be damaged
4.1a Rental/Hire Duration:
The standard rental period for props is 24 hours from delivery time on the [event date]. If the Client requires the props for a longer period, additional rental fees may apply.
Props must be returned in the condition they were received. A cleaning fee may be charged if props are returned excessively dirty or damaged.
Props must be returned on the agreed date and time. If the Client fails to return the props on time, an additional late fee of £20 per day will be charged until the props are returned.
5 Set Up/Delivery and Collection
5.1Delivery:
The Company will deliver the hired props to the Client’s event location at the agreed time and date. The Client is responsible for providing access to the location and ensuring that there is adequate space for the props.
5.2 Collection:
The Company will collect the props after the event at the agreed-upon time. The Client is responsible for ensuring that the props are available for collection and properly packed, if required.
5.3 Access and Setup:
The Client must ensure that the venue allows for the installation and setup of props. Any necessary access permissions or requirements (e.g., parking arrangements, loading bays, etc.) must be provided to the Company in advance. If additional time or resources are needed for delivery or collection, additional charges may apply.
5.4 Failure to provide timely access may result in delays or limitations in the ability to deliver the services in full. In such cases, The Company reserves the right to modify or reduce the scope of the services as necessary. Any such modifications are not considered a fault or breach of contract by The Company, and no refunds or compensation will be issued for changes resulting from access delays caused by the Client or the venue.
6.0 Damage or Loss:
If the props are returned damaged or missing, the Client will be charged for the full cost of repair or replacement, plus any associated shipping costs.
The Client is also responsible for any costs incurred due to props being lost or returned in an unusable condition (e.g., stained, broken, or irreparably damaged).
The Client agrees not to leave props outside overnight or unattended in public places, or in any location where the props may be exposed to theft, vandalism, adverse weather conditions, or other environmental factors that may cause damage. Props must be stored securely and protected from moisture, extreme temperatures, wind, and unauthorised handling at all times. Any damage or loss resulting from improper storage or negligence while the props are in the Client’s care will be the Client’s full responsibility and may be deducted from the damage deposit or invoiced separately if costs exceed the deposit amount.
Cotswold Balloons holds no liability for any injury or damage caused by the use of our balloon displays or props. Clients are responsible for ensuring the safety of their guests around our installations.
Any changes to the order (including the number of balloons, types of displays, or props hired) must be communicated to us at least one week before the event date. We will do our best to accommodate changes, but we cannot guarantee availability.
Your personal information will be kept confidential and used solely for the purpose of providing our services.
These Terms and Conditions are governed by the laws of England and Wales.
By booking with Cotswold Balloons, you agree to these Terms and Conditions in their entirety.
9. Force Majeure
Neither party will be held liable for failure to perform its obligations under this agreement if such failure is caused by events beyond its reasonable control, including but not limited to natural disasters, strikes, governmental restrictions, or other unforeseen circumstances.
